Road & Access Due Diligence

Access and private-road easements

Research legal access, private roads, gates and easement rights before buying Teton County, Wyoming property.

Reviewed September 2026

A beautiful driveway is not the same thing as legally enforceable access. Mountain property research should separate the physical route, the legal right to use it and the practical ability to reach the property year-round.

Three different access questions

Confirm whether the parcel connects to a public road, whether every private segment is covered by enforceable rights and whether the existing route matches the legal description. A gap anywhere in that chain deserves professional review.

Terms that can change the ownership experience

The instrument may address permitted users, residential or commercial use, guest and contractor traffic, gates, width, turnarounds, emergency access, construction traffic and whether utilities may share the corridor. Do not assume a right of passage includes every future use.

Wyoming’s private-road process

Wyoming Statute 24-9-101 provides a court process for an owner whose land has no outlet or connection to a public road to seek a private road. That is a legal proceeding with specific requirements—not a substitute for confirming ordinary access before purchase.

Mountain access is also physical

Legal access does not guarantee a manageable winter driveway. Evaluate grade, drainage, snow storage, avalanche or slide exposure where relevant, bridge capacity, emergency-vehicle access and the equipment needed to maintain the route.

Questions for the File

Do not leave these unanswered.

  1. 01Does the recorded route reach the parcel and the public road without a gap?
  2. 02Does the existing traveled road remain inside the described easement?
  3. 03Are gates, codes, guests, deliveries and construction traffic addressed?
  4. 04Can the right serve an additional residence or expanded use?
  5. 05Who controls changes to the surface, drainage, width or alignment?
  6. 06Can emergency vehicles and winter-maintenance equipment use the route?

Frequently Asked Questions

Start with the right distinction.

Is a visible road proof of legal access?

No. Physical use and legally enforceable access are different questions. Review recorded rights and the actual route.

Does an access easement include utility rights?

Not automatically. Utility installation and maintenance rights should be confirmed in the instrument and related documents.

What is a landlocked-property private road?

Wyoming law provides a court process for certain land without legally enforceable access, but eligibility and procedure require legal analysis.
